Can't Pay Rent in California: What Are My Options?

No statewide law gives you extra days to pay rent. Rent is due on the day your lease says, usually the 1st of the month. Many leases add a grace period (extra days before a late fee starts), often until the 6th. Read your lease to see if yours does.

No California statute sets a dollar cap on late fees. A late fee must be a reasonable estimate of what the late payment costs your landlord. A fee so high that it works as a punishment is not valid, and the court will not enforce it. The state's official tenant guide points to a court case where a landlord lost. Your landlord does not have to accept part of the rent. A 3-day notice to pay rent or quit asks you to pay all the past due rent within 3 days or move out. Your landlord only has to accept the full amount.

If your landlord agrees to take part of the rent now and the rest later, get that deal in writing with both signatures. Write down the amount paid, the date the rest is due, and that your landlord will not evict you if you pay by that date.

California's COVID-19 Rent Relief program ran during the pandemic. The state now lists it under Programs: Archived and describes it in the past tense, so it does not appear to take new applications. Statewide help now goes through CalWORKs Homeless Assistance, for families who get or qualify for CalWORKs. It can pay up to 2 months of back rent to stop an eviction. Apply at your county welfare office with form CW-42.

If a charity, agency, or relative pays your rent, your landlord must accept it. The payer must sign a short statement that they are not a tenant and are not becoming one. This rule does not force your landlord to sign a contract with a housing assistance program, such as Section 8.

A landlord may try to force you out by locking you out, shutting off utilities, or taking your belongings without your prior written OK. A landlord who does this owes you your actual losses. It also owes up to $100 for each day or part of a day it goes on, and at least $250 for each separate claim. The court must award reasonable lawyer's fees to the side that wins. You get this money only if you win your case and your landlord pays.
