Grace period

No statewide law gives you extra days to pay rent. Rent is due on the day your lease says, usually the 1st of the month. Many leases add a grace period (extra days before a late fee starts), often until the 6th. Read your lease to see if yours does.

Your landlord cannot charge you a late fee unless your rent payment is at least 7 days late.

The law gives you a grace period after your rent is due before your landlord can end your lease for not paying it. A grace period means the extra days you get to pay your rent. If you pay rent once a month, your grace period is 9 days counted from your due date. If you pay every week instead of monthly, your grace period is 4 days counted from your due date. If your lease has a written agreement to charge a late fee, your landlord cannot charge it until your grace period ends.

If your lease sets a late charge, your landlord cannot impose it within 5 days of the agreed time for paying rent. That wait is a grace period (days after rent is due when no late charge is allowed).

Say your Indiana landlord has accepted your late rent in the past. The landlord must then give you reasonable notice, best in writing, that late payments will no longer be accepted. After that notice, a late payment counts as a breach (a broken lease term).

In a 2024 Indiana case, the lease gave a 5-day grace period (a set number of days to pay after the due date). The lease also said it served as notice to leave. The Court of Appeals held the landlord did not need to give the 10 days notice. Read your lease for any grace period.

In a tenancy longer than week to week, your landlord cannot charge a late fee until at least 3 calendar days after rent is due.

In Maine, rent is late if you do not pay it within 15 days from the time it is due. That wait is a grace period (extra days before rent counts as late).

Massachusetts law gives you 30 days after your rent is due before your landlord can charge a late fee or interest. This 30-day period starts on the date rent was due under your lease.

If you rent by month to month or longer, your landlord must wait 3 calendar days after rent is due before charging a late fee. This 3-day wait does not apply if you pay rent weekly.

If you are a senior citizen, you get a 5-business-day grace period (extra time) before your landlord can charge you a late fee. A business day does not count Saturdays, Sundays, or state and federal holidays.

Your rent is due on the date and place your lease sets. Your landlord does not have to remind you or send a notice first before it's due. If your lease does not set a date, monthly rent is due at the start of each month.

Your landlord can only charge you a late fee if your lease sets a due date for rent and establishes an agreed upon late fee. Even then, the fee cannot start until your rent is 5 calendar days late. That counts weekends and holidays, starting from the day after rent was due.

Your rent is due on the date you and your landlord agreed to, usually the first day of your rental period. A rental period is the week or month your rent covers. Oregon law does not allow your landlord to treat your rent as due before that day.

Pennsylvania has no statewide law that gives you extra days to pay after the rent due date. A grace period (extra time to pay before a late fee starts) exists only if your lease gives you one. Read the rent part of your lease. It sets the amount, the due date, and any late penalty.

No Pennsylvania statute caps late fees for most rentals. The Attorney General's guidance says a late fee should not be too high. The fee should match what the late payment really costs the landlord.

South Carolina's rental law does not require your landlord to remind you or ask you for your rent before it is due. Your rent must be paid on the day and place you and your landlord agreed to in your lease. Because your landlord does not have to warn you first, mark your due date yourself and pay by then.

Your landlord can only charge a late fee if your lease says so. Rent must also stay unpaid for 2 full days after it is due. If rent is due on the 1st, no late fee is allowed on the 2nd or 3rd. The fee can start on the 4th. This 2-day rule only limits late fees. It does not stop an eviction for late rent.

Check your written lease first. If you and your landlord never signed a written lease, Virginia law sets the rules for you. Rent is due on the 1st day of each month, and it is not considered late until after the 5th day of that month.

In Washington, DC, a late fee is allowed only if you have not paid the full rent within 5 days after the due date. The lease may give a longer grace period (extra days to pay before late fees start).
