Can't Pay Rent in Alabama: What Are My Options?

  1. Alabama law says your rent is due at the exact time and place you and your landlord agreed to in your lease. Your landlord does not have to remind you or ask you for it first. There is no notice your landlord must send before your rent is considered due. Check your lease for the date and place you agreed to pay.

  2. If your lease does not list a rent due date, Alabama law sets a default. If your lease runs for a month or less, rent is due at the start of that term. For a longer lease, rent is due at your home at the start of each month. This rule only applies if your lease does not already say when rent is due.

  3. Your lease can set its own rules about paying rent. These rules cannot break Alabama law or any other law. Alabama's rental law leaves these terms to your lease. Read your lease closely to see what it says about late payments and fees.

  4. Contact your landlord as soon as you know you cannot pay your full rent on time. Do this before the rent is due if you can. Tell your landlord how much you can pay right now and when you expect to pay the rest of what you owe.

  5. You can ask your landlord if you can pay part of your rent now and pay the rest later. Your landlord does not have to agree to this. Explaining why you are behind and giving a clear date for the rest of the payment may help your landlord decide.

  6. If your landlord accepts part of the rent knowing you are behind, your landlord gives up the right to end your lease over it. This protection does not apply if you and your landlord agree otherwise after you fall behind on rent.

  7. Write down or send a text or email confirming anything you and your landlord agree to about paying late or paying part of your rent. Include the amount, the new date, and who agreed to it. This gives you your own record if there is a disagreement later.

  8. Keep a receipt, bank record, or screenshot of every rent payment you make, especially if you pay in parts or after the due date. If your landlord later claims you did not pay, these records show what you actually paid and when you paid it.

  9. Alabama pays local nonprofit groups and city or county governments across the state to help renters who are homeless or close to losing their home. This help can include paying rent. This funding can also help pay utilities (water, electric, gas) and moving costs.
